Acceptance of Terms

By using Y-Smart Chat, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

The Terms of Service govern service use, AI outputs, third-party providers, and liability. The Privacy Policy governs personal data handling. If these documents conflict, the Terms of Service prevail except where applicable privacy law requires otherwise.


Definitions

Third-party providers are external companies that provide AI models, hosting, authentication, payments, analytics, or other functions required to operate the service.

BYOK (Bring Your Own Key) allows users to connect external API keys so requests are processed under the user's provider account and governed by that provider's terms and settings. In BYOK mode, we act only as a technical routing layer.

Temporary Chat Mode is a session-based mode designed not to save chats to your permanent conversation history.

AI Outputs and Your Responsibility

Y-Smart Chat uses third-party AI models to generate responses.

AI outputs may be incorrect, incomplete, or misleading. Users are solely responsible for verifying outputs before use.

Y-Smart Chat is not professional advice (medical, legal, financial, or otherwise).

Users are responsible for how they use, share, or act on AI outputs, including harm arising from misuse of outputs. Users choose which models to use and accept the risks of that choice.

Y-Smart Chat routes and processes requests to operate the service. Third-party liability: see Terms of Service: Third-Party Providers.


Third-Party Providers

We do not control third-party provider behavior once data is transmitted, and are not responsible for their actions, availability, or policies.

Y-Smart Chat routes requests based on the model you select, service availability, and our routing configuration.


Model Training and Data Sale

We do not train our own models on user conversations. We configure routing to exclude providers that train on user inputs when our routing configuration supports exclusion.

We do not sell personal data.

We display warnings before routing to models with provider-side retention. Users may select another model or opt out for that chat when the product provides that option.

Data Deletion

When you delete conversations or your account:

Deletion is processed within a reasonable timeframe. Residual data may persist temporarily in backups, logs, or third-party systems until automatically purged.

Your Content and Rights

You retain ownership of content you create or upload. You grant us a limited license to host, process, and display your content only as needed to operate the service.

You may not:

  • Reverse engineer or bypass security or usage limits
  • Use the service to break the law or harm others
  • Scrape, resell, or overload the service without permission
  • Upload malware, spam, or content that infringes others' rights

Acceptable Use

You agree not to:

  • Post illegal content or facilitate illegal activity
  • Harass, threaten, or abuse others
  • Share malware, phishing, or spam
  • Violate others' privacy or intellectual property
  • Hack, probe, or disrupt the service
  • Abuse rate limits or usage caps with automated tools
  • Send excessive requests that impair the service for others

Pricing and Refunds

Usage limits and paid plans are shown in the app. Exceeding free limits may require waiting, upgrading, or using monthly overage where available.

You may cancel a paid subscription in account settings. Access continues until the end of the current billing period unless stated otherwise in the app.

Refund requests: contact support@y-smart.chat within 14 days of purchase. Refunds are reviewed case by case and are not automatic in every situation.

Beta features are experimental and may change or be removed without notice.


Warranty Disclaimer

Y-Smart Chat is provided "as is" and "as available." To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or universal fitness for every use case.


Limitation of Liability

To the fullest extent permitted by law, Y-Smart Chat and its operators are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or goodwill).

Our total liability for any claim related to the service is limited to the greater of (a) amounts you paid us in the 12 months before the claim, or (b) one hundred U.S. dollars ($100).

Jurisdictional limits: Where law prohibits certain exclusions or caps, those limits apply only to the maximum extent permitted. Where a limitation cannot be enforced, liability is limited to the minimum amount required by applicable law.

Indemnification

You agree to defend and indemnify Y-Smart Chat against claims, damages, and reasonable costs arising from your content, your actions, your illegal activity, your breach of these Terms, or your misuse of the service (including misuse of AI outputs).

You are not responsible for incorrect AI outputs alone, provider failures, or routing decisions we make in normal operation. You are not required to indemnify claims caused by our intentional misconduct or negligence where law forbids that.

Privacy Policy

Personal data is handled under our Privacy Policy.

Termination

By you

You may stop using the service and delete your account in Settings, or contact support@y-smart.chat for deletion assistance.

By us

We may suspend or terminate access for violations of these Terms, abuse, fraud, or risks to the service or other users, including but not limited to the grounds listed above. Notice may be provided where practical but is not required in every case.

After termination

  • Access ends when termination takes effect
  • Deletion is processed within a reasonable timeframe. Residual data may persist temporarily in backups, logs, or third-party systems until automatically purged.
  • Surviving provisions (including disclaimers, liability limits, and indemnification) remain in effect

Changes to Terms

We may update these Terms when the service or law changes. Material changes will be reflected in the "Last updated" date and, where appropriate, notice in the app or by email. Continued use after the effective date constitutes acceptance.


Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.

Disputes are brought individually in Delaware courts, not as a class action, except where law requires otherwise.

Feedback: We may use feedback without compensation.

Entire agreement: These Terms and the Privacy Policy constitute the entire agreement. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign rights without our consent.

International use: Data may be processed in the United States and other regions where providers operate.
